Cloud Blvd Terms and Conditions

1 About these Terms

These Terms & Conditions (Terms) govern access to cloudblvd.com.au, customer accounts, online orders and related services supplied by Cloud Blvd Trading Pty Ltd (ABN 79 667 509 435, ACN 667 509 435) (Cloud Blvd, we, us or our).

Cloud Blvd is an Australian retailer operating online and from its Queen Victoria Building boutique in Sydney. We also accept online orders to selected overseas destinations where those destinations and delivery options are available at checkout.

By using our website, creating an account or placing an order, you agree to these Terms. If you do not agree, you should not use the website or place an order. You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to place an order.

Our Shipping and Delivery Policy, Returns and Exchanges Policy, Privacy Policy and the Cloud Club Rewards Terms in section 11 form part of these Terms. Separate terms may apply to gift cards, promotions, competitions or particular services. Cloud Blvd does not currently accept pre-orders, backorders, product deposits or store reservations. Section 11 governs a rewards-specific issue; the other sections of these Terms govern the underlying sale. Specific terms disclosed before purchase govern that specific offer if there is an inconsistency, but nothing excludes rights that cannot lawfully be excluded.

Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those guarantees or any other non-excludable right or remedy.

2 Website use and customer accounts

You may browse without an account. If you create an account, you must provide accurate information, keep login credentials secure and promptly tell us if you suspect unauthorised access. You are responsible for activity performed through your account to the extent it results from your failure to take reasonable care of your credentials.

We may reasonably restrict or suspend an account to investigate suspected fraud, misuse, security risks or a material breach of these Terms. Where practicable, we will explain the reason and give you an opportunity to respond. We will not exercise this right arbitrarily or in a way that removes accrued legal rights.

3 Product information sizing and availability

We take reasonable care to describe and display products accurately. Colours can vary between screens, and measurements, handmade details, lace placement and dye lots may vary within reasonable manufacturing tolerances. Size and fit information is guidance and does not guarantee that every style will fit identically.

Products are subject to availability. Adding an item to a cart does not reserve it. We may limit quantities where reasonably necessary to protect stock availability, enforce a disclosed promotion, prevent fraud or stop unauthorised resale.

You should follow garment labels and our care instructions. Hygiene restrictions for intimate items apply only to our voluntary change-of-mind policy and do not remove rights for faulty, unsafe, incorrectly supplied or misdescribed goods.

4 Prices currency taxes and discounts

Prices and the currency charged are shown on the website and confirmed at checkout. Australian consumer prices include GST where applicable. Delivery charges and any other applicable amount are disclosed before you place the order. International customers may also be charged import duties, taxes or customs fees by local authorities unless checkout expressly states they are included.

We may change prices for future orders. A price change does not alter an order we have already accepted. If more than one price is displayed for the same item, we will comply with applicable price-display law, including selling at the lowest displayed price or pausing the sale while the error is corrected where required.

Discount codes, rewards and promotions are subject to their disclosed conditions. Unless checkout or the applicable promotion expressly permits it, only one discount or reward code may be used per transaction. Discounts cannot be applied retrospectively, redeemed for cash or used after expiry. We do not provide change-of-mind price adjustments for purchases made before a later promotion.

5 Orders and when a contract is formed

Submitting an order is an offer to buy the items at the checkout total. An automated order confirmation acknowledges receipt but does not by itself mean we have accepted the order. We accept an online delivery order when we send a dispatch confirmation. We accept a Click and Collect order when we send a ready-for-collection notice. Payment may be authorised or captured before acceptance.

Before acceptance, we may decline or cancel an order for an objectively reasonable reason, including unavailable stock, an evident pricing or description error, inability to deliver to the address, purchase-limit or promotion misuse, suspected fraud or resale, a failed payment, inability to complete reasonable identity verification, or a legal restriction. We will notify you and promptly release or refund any amount taken.

After acceptance, we may cancel only where we cannot lawfully or reasonably supply the order, where you agree, or where a right to cancel exists under law. We will notify you, refund the affected amount and provide any further remedy required by law.

If you ask to change or cancel an order, contact us immediately. We will try to help before fulfilment, but cannot guarantee a change once processing or dispatch has begun. This does not affect rights under the Australian Consumer Law or our Returns & Exchanges Policy.

6 Payment and verification

We accept the payment methods displayed at checkout, which may include Visa, Mastercard, American Express, UnionPay and JCB through Shopify Payments, as well as Shop Pay, PayPal, Afterpay, Apple Pay and Google Pay. Available payment methods may vary depending on your location, device, order value and eligibility.

Payment must be authorised before an order can be accepted. If payment cannot be authorised, or is subsequently reversed before acceptance, we may decline or cancel the order and will notify you where reasonably practicable. Once an order has been accepted, our cancellation rights are limited as described in section 5 and by applicable law.

Payments made through third-party providers, including PayPal and Afterpay, are also subject to that provider's eligibility requirements and terms. Afterpay purchases may incur late fees in accordance with Afterpay's terms.

Prices are displayed and charged in the currency shown at checkout. Available currencies may depend on your selected market or delivery destination. Your bank or payment provider may apply currency-conversion, international-transaction or other charges that are outside our control.

You authorise us and our payment providers to charge the checkout total and perform reasonable fraud and payment verification. We may request proportionate evidence to verify identity, payment authority or delivery details. If verification cannot be completed within a reasonable time, we may decline the order and promptly refund or release the payment.

Payments are processed through secure third-party payment providers. We generally do not receive or store customers' full payment card numbers, although we may receive transaction information and limited payment identifiers such as the payment method, card type and partial card details. Our Privacy Policy explains how we handle payment and transaction information.

Cloud Blvd does not impose a payment-method surcharge. In particular, we do not add a surcharge for Visa, Mastercard, American Express or eftpos card payments. Nothing in this section limits any right or remedy available under the Australian Consumer Law.

7 Shipping delivery and international orders

The shipping options below apply as at the effective date. The options and total charge available for your address are shown before you place the order. Any later change applies only to future orders. Free-shipping thresholds are calculated on the merchandise subtotal after discounts and before shipping charges.

Delivery estimates begin after dispatch, exclude weekends, public holidays and customs processing, and are not guarantees. Orders are usually processed in 0 to 1 business days, although launches, promotions and high-volume periods may take longer. We will take reasonable steps to dispatch on time and keep you informed of material delays.

Australian orders of at least $150 AUD and New Zealand orders of at least $350 NZD qualify for complimentary Express delivery. Free Click and Collect is available from Cloud Blvd at Lower Ground 2, Shop 14, Queen Victoria Building, 455 George Street, Sydney. Orders placed before 3 pm Sydney time may be ready the same day, subject to stock and opening hours; wait for the ready-to-collect email before attending.

Orders are sent in discreet, unbranded packaging. Tracking is provided and signature is requested where available. If tracking shows delivered but the parcel is missing, contact us promptly so we can investigate with the carrier. A delivery instruction you gave the carrier may be relevant to that investigation but does not remove rights that cannot lawfully be excluded.

If we know an item cannot be supplied by a promised date or within a reasonable time, we will contact you and offer an appropriate solution, which may include a revised timeframe, replacement or refund. Our use of Australia Post, DHL or another carrier does not remove any responsibility we have under applicable law.

You must provide a complete and accurate delivery address. Tell us about a correction before dispatch. We may recover reasonable direct costs caused by an incorrect address or an unauthorised redirection, provided those costs are disclosed or evidenced and were not caused by us. Where you expressly authorise unattended delivery, delivery may be completed at the authorised location, subject to applicable law.

For international orders, you are responsible for import duties, taxes and customs requirements unless checkout states otherwise. We declare the full order value where required. If a parcel is refused or returned because required charges were not paid, we may deduct the original outbound shipping charge, the carrier's return-to-sender charge and a $20 AUD administration fee representing reasonable handling costs, but only after the goods are returned and assessed and only to the extent the deductions are permitted by law and reasonably reflect our costs.

8 Returns exchanges and Australian Consumer Law remedies

Our voluntary Returns and Exchanges Policy permits eligible change-of-mind returns lodged through the Returns Portal within 30 days of delivery, subject to the item being unworn, unused, unwashed, unmarked, free of odour, in original condition and with tags attached. Eligible change-of-mind outcomes are store credit or an exchange where offered and subject to stock. We do not provide cash refunds for change of mind.

For hygiene reasons, hosiery, bottoms and bodysuits, and items expressly marked Sale or Final Sale, are excluded from change-of-mind returns. These exclusions do not apply where the item is faulty, unsafe, incorrectly supplied or otherwise fails a consumer guarantee.

A Standard Exchange is created after the returned item is received and approved. Where Instant Exchange is offered, the replacement may be created immediately. By choosing Instant Exchange, you authorise a temporary refundable USD $1 card hold and, if the original item is not lodged with the carrier specified in the Returns Portal within seven calendar days of approval, a charge for the full value of the exchange item. Bank timing and local-currency display of the hold may vary. Checkout+ does not remove these requirements.

Checkout+ is optional return-shipping coverage for the fee shown at checkout. It covers the cost of one return label per order for an eligible change-of-mind return lodged within 30 days. It does not change product eligibility or make Sale, hosiery, bottoms, bodysuits or other hygiene-excluded items returnable. The fee is generally non-refundable after the order is placed, except where required by law or the service cannot be provided. Checkout+ is not required for a faulty, damaged or incorrectly supplied item.

Approved returns must be lodged with the specified carrier within seven days. If Checkout+ was not purchased, the customer buys the eligible return label through the portal. Original delivery, gift-wrapping, duties and taxes are not refunded for change-of-mind returns. Online change-of-mind returns and exchanges cannot be processed at the QVB boutique. Allow up to seven business days after delivery to our warehouse for assessment and processing.

For confirmed faulty or incorrectly supplied items, we will provide or reimburse reasonable return costs as required by law. Where goods have a major problem, you are entitled to choose a refund or replacement. For a minor problem, we may choose to repair, replace or provide another lawful remedy within a reasonable time. A refund for a consumer-guarantee failure will be provided to the original payment method unless you agree otherwise; store credit will not be imposed. The 30-day voluntary return period, Sale and hygiene exclusions do not restrict statutory rights.

9 Sets bundles and multibuy promotions

A set, bundle or multi-buy promotion may have conditions stated on the product or promotion page. For a change-of-mind return involving a set, bundle or multi-buy promotion, the store credit will equal the net amount allocated to the returned item after discounts, as shown in the original order. Retained items will not be retrospectively repriced. This does not reduce a remedy for faulty goods below what the law requires.

10 Gift cards promotional vouchers and store credit

Purchased gift cards are valid for at least three years from the date of supply, or any longer period displayed, and do not attract prohibited post-supply fees. The expiry date and material use restrictions will be shown on or with the gift card. Purchased gift cards may be used online and at Cloud Blvd boutiques. Gift cards are not redeemable for cash except where required by law.

Promotional vouchers and rewards may have different validity periods where permitted by law, provided those periods and restrictions are clear before issue or use. All Cloud Blvd store credit is valid for 12 months from the date of issue. The expiry date will be displayed when the store credit is issued. Store credit may be used online or at participating Cloud Blvd boutiques and is not a substitute for a refund where the law gives you a right to one.

11 Cloud Club Rewards Terms

These Cloud Club Rewards Terms apply from 12 October 2026. Cloud Club is operated by Cloud Blvd Trading Pty Ltd (ABN 79 667 509 435) trading as Cloud Blvd. This section contains the complete customer-facing program rules. The Rewards page and joining flow may summarise the program but do not replace this section.

11.1 Joining Cloud Club

Membership is free and available to Australian residents shopping for personal use. You must be legally able to agree to these Terms, or have the involvement and permission of a parent or legal guardian. You may shop without joining. Joining does not require you to subscribe to marketing.

Create or activate your Cloud Blvd customer account and provide accurate contact details. Use the same email address for online and QVB purchases and identify yourself before an in-store transaction is completed. You may hold one membership per person, although genuine members of the same household may each hold an account.

These rules apply when you join, earn or redeem rewards after receiving a reasonable opportunity to read them. Membership, points and rewards cannot be sold, transferred, shared or combined with another person's account. Contact us to correct details, recover an account or reconcile duplicate accounts belonging to you. We will take reasonable steps to verify ownership and preserve legitimate balances without repeating one-time bonuses.

11.2 Program scope and eligible spend

The program has no VIP tiers, tier thresholds, tier-entry gifts, tier-specific birthday benefits or ongoing tier-based shipping entitlements. Facebook activity does not earn points. Other promotions or personal offers apply only when separately advertised. Benefits already issued or validly earned under earlier promises are protected under section 11.12.

Eligible product spend is the Australian-dollar price of eligible merchandise, including GST, after discounts and before excluded charges. Delivery, duties, tips, service fees, Checkout+, gift wrapping and gift-card purchases do not earn points or count towards reward minimums. Ordinary merchandise, including Sale merchandise, is eligible unless a product or campaign exclusion is clearly disclosed before purchase.

Eligible online purchases must be delivered within Australia. Eligible in-store purchases must be made at the QVB boutique and recorded against the member's account. All program values are in Australian dollars. Existing overseas members retain accrued rights and valid issued rewards under their earlier conditions, but new international purchases and new international referral activity do not earn.

A qualifying purchase for a purchase milestone is a genuine, fully paid purchase with positive eligible product spend recorded against the member's account. Test orders, unpaid or fully refunded purchases, fee-only or gift-card-only orders, administrative duplicates, free replacements and administrative exchange transactions do not qualify. Merchandise paid for using a valid gift card or store credit may qualify when it represents a new eligible purchase rather than a duplicate of an earlier transaction.

Purchase points are calculated on eligible spend after all discounts, including any Cloud Club discount, and rounded to the nearest whole point with half a point rounded up. Points are credited after the paid purchase is processed and may take time to appear while records synchronise. Converting points to a reward code does not itself earn points.

Buying a gift card does not earn points. Buying eligible merchandise using a gift card or legitimate store credit can earn points, subject to the return adjustments below. Free items and free replacements do not earn purchase points. An additional payment on an exchange may earn points on that additional eligible expenditure only.

Account-activation points are not awarded again when you change email addresses, recreate an account or merge accounts. The Instagram action must be completed through the Rewards panel. It awards points for completing the panel action and does not verify an ongoing follow. Completing a follow outside the panel does not automatically award points.

11.4 Second purchase bonus

You receive 150 bonus points when you complete your second lifetime qualifying purchase on or after 12 October 2026. There is no A$100 minimum for this bonus, and ordinary purchase points are awarded separately. Historical qualifying purchases count towards the milestone, but no retrospective bonus is issued where two or more qualifying purchases were already completed before that date.

Only one retained second-purchase bonus is available per person across online and QVB purchases. If the purchase earning the milestone is cancelled or fully refunded, we may reverse the bonus. A partial return does not remove it where positive eligible product spend remains. If a bonus is reversed because the purchase no longer qualifies, a later purchase may complete the second qualifying purchase without producing two retained bonuses. Contact us if a technical order count includes an excluded transaction.

11.5 Birthday points

Enter your genuine birth month and day in the Rewards panel at least 30 days before your birthday to receive 200 birthday points that year. If you enter the date within 30 days of your birthday, eligibility ordinarily begins the following year. Changing the date does not create another award within 365 days.

Birthday points follow the rewards provider's processing schedule and may not appear at midnight in your local timezone. The benefit is points added to your balance, not an automatic A$10 voucher. Providing birthday information is optional; without it the benefit cannot be administered.

Each point represents A$0.05 of discount value when used through the available reward options. Points are promotional benefits, not cash, a bank balance, store credit or a purchased gift card. They cannot be exchanged for cash or used to pay excluded charges.

Minimum spend is measured on eligible merchandise including GST, after existing product price reductions and before the Cloud Club reward is applied. The threshold must be met in one transaction and purchases cannot be combined. Members with larger balances may choose a smaller reward.

Online, sign in to the Rewards panel, choose an available reward and apply the generated code. Points are deducted when the code is created, not when the order is completed. If you leave checkout without buying, an unused code remains available in your rewards account. At QVB, identify your account before payment and ask our team to apply an available in-store reward.

Only one Cloud Club reward may be used per order. Ordinary points rewards do not combine with another Cloud Club reward, referral code or product or order discount code unless checkout expressly permits it. Marked-down merchandise remains eligible unless a clearly disclosed campaign restriction applies. A separate shipping offer combines only where its conditions allow.

Shipping charges and free-shipping eligibility are determined under the Shipping Policy using the final discounted basket. Applying a loyalty reward can affect whether a shipping threshold is met. Points do not guarantee free shipping, express shipping or gift wrapping.

Rewards belong to the member who redeemed them and must not be sold, publicly distributed or used through another person's account. If an unused code was redeemed in error, contact us. After confirming it has not been used, we may cancel it and restore the points; the code and restored points cannot both be used.

11.7 Expiry and missing points

Points and newly redeemed ordinary points reward codes do not routinely expire under this version of the program. A separately advertised promotional code or previously issued reward may have its own clearly stated expiry, which continues to apply. Any future expiry change must follow section 11.15 and protect previously earned benefits.

Check your account and contact us if a reward or eligible purchase is missing. Where possible, report a missing award within 90 days and provide the order number and account email. This is an administrative request window, not a limitation on statutory rights. We will consider reasonable explanations for a later request and correct verified errors.

11.8 Referral offer when available

This subsection applies only while the A$10 referral offer is expressly published and active. Share your own Cloud Club referral link with a genuine new customer who has never completed a Cloud Blvd purchase. The friend must use the offer on their first online order delivered in Australia.

The friend receives A$10 off at least A$100 of eligible merchandise, measured after existing product price reductions and before the referral discount. The friend therefore pays at least A$90 for those eligible products plus applicable delivery. The referral offer does not combine with another product or order discount code and is not offered at POS unless expressly advertised.

The referring member receives 200 points 30 days after payment if the referred purchase remains qualifying. A cancelled or fully refunded order, fraud, or a return reducing the qualifying pre-referral-discount merchandise below A$100 does not qualify. A later disqualifying return may reverse only the associated referral award. Sharing a link alone does not earn points.

You must not refer yourself, use another identity for yourself, create artificial accounts or arrange sham purchases. Different genuine people at the same address are not automatically excluded. Referral links are for personal recommendations and must not be distributed through paid advertising, coupon sites, unsolicited bulk messages or commercial resale without our written agreement. Do not give us a friend's contact details without permission.

If the pilot ends, eligible referrals completed before closure will be honoured after the review period. Issued friend codes retain their disclosed conditions. We may investigate genuine attribution errors but cannot guarantee a referral where the required link or code was not used.

11.9 Returns refunds and exchanges

Our Returns and Exchanges Policy and Australian Consumer Law rights apply to purchases made using rewards. Change-of-mind hygiene and Sale exclusions do not remove statutory remedies for faulty, unsafe, incorrectly supplied or misdescribed goods.

Where a refund is due, the monetary refund reflects the price actually paid and the applicable legal remedy. A reward discount is not refunded as cash. For a full cancellation or refund, we restore points spent on the purchase and remove purchase points earned on the refunded expenditure. An already-used reward cannot also be reissued as an unused code.

For a partial refund, the original reward discount is allocated to returned items using the order's recorded allocation. We restore the corresponding spent points, rounded to the nearest whole point, and remove points earned on returned expenditure. We do not retrospectively reprice retained items or automatically claw back their discount merely because a genuine return reduces the remaining basket below the original minimum.

For a return to store credit, points earned on returned expenditure are removed so later use of the credit does not duplicate the reward. A free replacement or administrative exchange does not earn a second award on the original expenditure. An exchange top-up may earn points on additional eligible expenditure. Bonus reversals follow the relevant eligibility rule.

11.10 Adjustments and insufficient balances

We may correct verified duplicate awards, processing errors, refunded-purchase awards or points obtained in breach of these rules. A correction will be limited to the affected benefit and based on the transaction's actual earning and redemption rules. We will keep appropriate records and explain a material correction on request.

If points that should be reversed have already been spent, we may offset the correction against future points or make an equivalent account adjustment supported by the system. We will not collect a cash debt merely because the balance is insufficient, deduct a points liability from a lawful cash refund, or remove unrelated legitimate benefits. You may dispute the calculation through our complaints process.

11.11 Account security and misuse

Keep your account secure and contact us promptly if you suspect unauthorised use. We may temporarily restrict affected rewards where reasonably necessary to investigate account theft, fraud or a material breach. We will act proportionately, explain the reason where reasonably possible and provide an opportunity to respond.

Confirmed misuse may result in cancellation of improperly obtained rewards or, for serious or repeated misuse, closure of membership. Legitimately earned unrelated benefits are not automatically forfeited. Shared addresses or devices alone do not establish misuse, and our decision does not prevent you using an available complaint or legal process.

11.12 Existing balances and earlier benefits

Existing points previously valued at A$0.01 each are converted to points valued at A$0.05 each by dividing the old positive balance by five and rounding up to the next whole point. For example, 2,000 old points become 400 new points and retain A$20 of reward value. This conversion is separate from changing the earning rate on future purchases.

Previously issued vouchers and gifts remain valid under their original conditions. New reward minimums are not retrospectively imposed on issued codes. Although this program has no new VIP tiers or recurring tier benefits, benefits already issued or validly earned under previous promises will be honoured.

Members with migrated balances retain access to the earlier A$50 reward for 1,000 new points and A$100 reward for 2,000 new points, under their previous redemption conditions and against their remaining migrated entitlement. Contact us if an applicable option is not visible. Later-earned points do not expand that historical entitlement, and ordinary redemptions use migrated entitlement first so the remainder can be reconciled.

If you are affected by a migration error, an unconverted account without email or a historical refund, contact us for an account review. We will reconcile legitimate reward value and activity so a technical conversion does not cause loss of earned value. Existing negative balances require individual review rather than an automatic positive credit.

11.13 Privacy and communications

We use account details, purchase and return records, reward activity, referral information and optional birthday month and day to administer the program, prevent misuse and provide permitted communications. Shopify, Smile and Klaviyo may process relevant information for us, including through service providers outside Australia, as described in our Privacy Policy.

Membership does not itself constitute express marketing consent. Promotional email, SMS, reward reminders and referral promotions are sent only where we have a lawful consent basis. You may unsubscribe without losing membership or legitimate points. We action marketing unsubscribe requests within five working days and do not require account login or a fee to unsubscribe.

We may send necessary account or order service messages where permitted by law. We do not treat a promotional message as a service message merely because it concerns rewards. The Privacy Policy explains access, correction, overseas handling, retention and privacy complaints.

11.14 Leaving the program

You may request closure through our Contact page. Unsubscribing from marketing does not close membership. Before voluntary closure, we will explain the effect on remaining points and provide a reasonable opportunity to redeem. If you proceed, unredeemed points end with membership, subject to rights that must be preserved by law. Previously issued valid codes retain their disclosed conditions unless cancellation is necessary and lawful.

11.15 Changes and program closure

We may make reasonable changes for legitimate operational, security or legal reasons. We will clearly explain a material change that disadvantages members and ordinarily give at least 30 days' notice, and longer where reasonably needed. We will not retrospectively reduce the discount value of already-earned points or remove earned benefits merely by publishing new terms. We will preserve an equivalent redemption opportunity or provide a fair alternative agreed with the affected member.

An urgent change required by law or reasonably necessary to address a serious fraud or security issue may take effect sooner, with notice as soon as reasonably practicable. It will be limited to what is reasonably necessary and will not be used to confiscate unrelated earned benefits.

If we close the program, we will ordinarily give at least 90 days' notice and a meaningful opportunity to redeem valid points. Where redemption is not reasonably possible, we will arrange a fair equivalent benefit or another remedy required by law. Existing codes retain their stated conditions or an equivalent opportunity. These notice periods are Cloud Blvd policy and do not suggest the law prescribes the same fixed period in every case.

11.16 Errors outages and consumer rights

If a technical outage, incorrect display or administrative mistake affects a legitimate award or redemption, contact us. We will investigate and take reasonable steps to correct it or provide an equivalent opportunity. We do not exclude responsibility for our unlawful conduct or remove remedies available under the Australian Consumer Law.

Nothing in this section excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. Section 11 governs rewards; the remaining Terms and the Shipping and Returns policies govern the underlying purchase, subject to statutory rights. If another general website clause conflicts with the earned-benefit and notice protections in section 11, those program protections apply to the rewards issue.

11.17 Contact and complaints

Contact Cloud Blvd through cloudblvd.com.au/pages/contact-us or ask the QVB team to direct a rewards enquiry to customer support. Provide your account email, relevant order number and the issue, but do not send passwords or unnecessary identity documents. We aim to acknowledge complaints within five business days and explain the outcome or next step.

If a concern remains unresolved, you may seek assistance from NSW Fair Trading, another relevant consumer-protection body or a competent court or tribunal. Privacy complaints may be raised under the Privacy Policy and, where applicable, through the Office of the Australian Information Commissioner process.

12 Promotions competitions and gift wrapping

Promotions and competitions may have separate terms covering eligibility, dates, stock limits, exclusions, reward conditions and the method of determining winners. We will present material conditions prominently and will not describe an offer as limited, discounted or reduced unless the representation is accurate and supportable.

Gift-wrapping availability, price and eligibility are shown in the cart or at checkout. For Australian online orders, one complimentary gift-wrapping service may be automatically added when the discounted merchandise subtotal reaches A$170. Gift wrapping is currently not offered for other delivery markets. The benefit is subject to availability, has no cash or credit value, and a gift-wrapping charge is not refunded for a change-of-mind return.

13 Reviews photographs and other content

If you submit a review, photograph, social post, competition entry or other content, you confirm that it is truthful, lawful, your own or properly licensed, and does not infringe another person's rights or reveal personal information without permission.

You retain ownership. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and promote the content for Cloud Blvd's business and marketing purposes. The licence continues for content already used in published materials, but we will consider reasonable removal requests where practicable. We may moderate or remove content for a legitimate reason, including illegality, abuse, fraud, irrelevance or infringement.

14 Marketing email and SMS

Marketing consent is voluntary and is not a condition of purchase or Rewards membership. Where you consent, or where otherwise permitted by law, we may send commercial email or SMS that identifies Cloud Blvd and includes a functional unsubscribe method. You may unsubscribe at any time using the link, replying STOP where available, updating preferences or contacting us. We will action requests within the period required by law.

15 Intellectual property

The website and its text, photographs, graphics, designs, logos, trade marks, lookbooks, videos and software are owned by or licensed to Cloud Blvd and protected by intellectual-property law. You may access and make a temporary personal copy for non-commercial shopping use. You must not reproduce, scrape, distribute, modify, sell or commercially exploit website content without permission, except where law permits.

16 Third party services and links

Our website may link to or integrate third-party services such as payment, delivery, reviews, returns, rewards, social media and buy-now-pay-later providers. Their separate terms may apply when you choose to use them. We are responsible for our own supply and cannot exclude responsibility that the law places on us, but we do not control an independent third party's separate website or service.

17 Prohibited conduct

You must not use the website to break the law; commit fraud; impersonate another person; interfere with security or operation; introduce malicious code; scrape or harvest data without permission; infringe rights; submit abusive, discriminatory or unlawful content; abuse promotions or Rewards; or purchase for unauthorised resale. We may take proportionate steps to prevent or respond to this conduct.

18 Privacy

Our Privacy Policy explains how we collect, hold, use and disclose personal information, including information connected with orders, accounts, tracking technologies, marketing and the Cloud Club. This may include use of service providers located outside Australia. Privacy choices and marketing consent are handled in accordance with that policy and applicable law.

19 Website availability and errors

We aim to keep the website accurate and available but do not promise uninterrupted or error-free access. We may maintain, secure, update or temporarily suspend the website. If an error affects an order, we will act reasonably, notify you where appropriate and provide any remedy required by law.

20 Liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, warranty, right or remedy that cannot lawfully be excluded or limited, including under the Australian Consumer Law.

To the maximum extent permitted by law, we are not liable for loss that was not reasonably foreseeable, was caused by your unlawful or negligent act, or results from an independent third-party service that we did not select or control. We do not exclude liability to the extent loss was caused by our fraud, wilful misconduct, gross negligence, breach of a non-excludable guarantee, or another liability that cannot lawfully be excluded.

You are responsible for reasonable loss we suffer to the extent directly caused by your fraud, unlawful conduct, material breach of these Terms or infringement of another person's rights. This is not an unlimited indemnity and does not apply to loss caused or contributed to by us.

21 Suspension and termination

You may stop using the website or ask us to close your account. We may suspend or terminate access for a material breach, fraud, security risk, unlawful conduct or repeated misuse, using a proportionate process and notice where practicable. Termination does not remove rights or obligations that arose before termination, including accepted orders, refunds, privacy rights and consumer remedies.

22 Changes to these Terms

We may update these Terms for future use to reflect changes in law, services, technology or business practices. We will publish the new effective date and provide reasonable additional notice where a change is material. A change will not retrospectively alter an order already accepted unless required by law or agreed with you.

23 Complaints and disputes

Please contact us first so we can try to resolve a concern promptly. Nothing in these Terms prevents you from contacting NSW Fair Trading, the ACCC or another regulator or dispute-resolution body, or from exercising legal rights. The ACCC generally does not resolve individual consumer disputes.

24 Governing law and general provisions

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, without limiting any right you have to bring a claim elsewhere under applicable consumer law.

If you are a consumer outside Australia, these Terms do not exclude any mandatory consumer right or remedy that applies in your country and cannot lawfully be excluded by agreement.

If a provision is unlawful or unenforceable, it is read down or severed only to the extent necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver. We may transfer these Terms as part of a genuine sale or restructure of our business only if your existing rights are preserved and there is no material detriment, and we will notify you where appropriate.
